Terms of Service for Non-Commercial Emergency Commissions

“The Artist” refers to me (Elisa, @FantadyM)
“The Client” refers to the individual commissioning or intending to commission The Artist.(Will only accept commissions from 18 or older clients!)Notice: The Client MUST contact The Artist via their social media before purchasing a commission.1. The Artist reserves the right to decide which projects to take on or refuse at their own discretion.2. The Client understands that there will be no physical product, as all will be provided digitally.3. Upon confirmation of The Clients commission they must pay 100% upfront. Payment will be done through PayPal through a provided invoice (under Goods and Services ONLY) or Ko-fi. The Client will NOT send payment before the commission is accepted. Should The Client do so they will be issued a partial refund and the project will be declined by default.4. The Client understands that once payment is sent they will NOT be able to request a full refund. The Artist will only be able to send a partial refund if work has not been started on the commission. Once The Artist has started the commission The Client will be unable to request a refund.5. The Artist reserves the right to refuse, cancel or issue a partial refund for any commission due to (but not limited to) abusive behavior, unwillingness to communicate or if The Client is found to be under 18 (Especially in regard to N5FW commissions). Should The Client be refused for any one of these reasons they may be blacklisted from future commissions.6. The Client will have the opportunity to request changes, free of charge, during the sketch phase (Does not apply to sketch ONLY Commissions). During which The Artist will send continuous updates to ensure the desired posing and details. Should The Client wish to change the type of drawing (Portrait to Waist up or Full body) or add additional character the price will be adjusted accordingly. The Client cannot request a change to a cheaper option after the project has begun (Exclusive to Emergency Commissions)7. Changes requested after the aforementioned stage will incur an extra charge depending on the scale of the change.8. Should The Client request a PayPal chargeback at ANY point The Client will lose all rights mentioned in the terms of service and The Artist will provide PayPal with all conversations had with The Client.9. The Artist endeavors to keep all clients up-to-date with the progress of their commission at regular intervals. This will be via email PREFERABLY (unless reasonable accommodations are requested). Should The Client fail to keep in contact for a lengthy amount of time (2 weeks at most) The Artist may halt all work on the project.10. The final product will be sent via email upon completion. The Client may also request the source files (though some will only open with specific applications)11. Only the watermarked version of the final product may be uploaded to The Clients personal gallery.12. Digital images will be sent in .png format, though other specific formats may be requested. All Digital images are done in 300dpi usually at 8 ½ x 11 in., but other sizes and resolutions can be discussed. Traditional ones will be done on 5 ½ x 8 ½ in. paper and a photocopy or pictured version will be sent to The Client.13. The Artist reserves the right to upload or display any work produced unless discussed otherwise with The Client.14. The Client may not reproduce, edit, sell or otherwise profit from the produced work. Should The Client break this term The Artist retains full right to the commission piece (not including copyright).15. These Terms may be updated or changed at any time.
